Sexual Assault

Alternatively, sexual assault may occur when someone forces another to touch some aspect of their anatomy. It must occur against the will of the alleged victim, and can be accomplished with force or threats of force.  This is a Class 1 Misdemeanor.

Aggravated Sexual Assault

This crime is identical to Sexual Assault, except that this is a felony.  The difference between the two charges, is that the alleged victim in this instance was under 13 years of age, or, mentally / physically handicapped.  Alternatively, if the perpetrator is a parent, step parent or grandparent, they may be charged under this statute as well.  This is an unclassified Felony with a sentencing range between 1 and 20 years.

Sexual Battery When Infected

This crime occurs where the perpetrator knowingly infects their partner with a sexually transmitted disease, such as HIV, Syphilis or Hepatitis B.  This is a Class 6 Felony.

Rape

Rape is an extremely serious offensewhere the alleged perpetrator is accused of forcing another to have sexual intercourse by means of force, threats, intimidation or by mentally / physically incapacitating the alleged victim.  The penalty for rape includes up to life in prison.

Sex Offender Registry

A conviction in any of the above offenses has extremely serious consequences.  One of collateral consequences if you are found guilty of one of the above charges is that you will have to register as a sex offender if they are found guilty.  Undoubtedly being placed on the registry will have unbelievable consequences to one’s personal and professional life.
